Terms of Service
Last updated October 30, 2026 · Operated by After Key Solutions Ltd (59-4660587)
The short version. Afterkey stores an encrypted note and releases it to the person holding your heir card when the rules you set are met. It is not a will, not legal or financial advice, and not a custodian: we never hold or move your crypto. Keep your passphrase safe, because we can't recover it. Treat heir cards like keys.
1. Agreement
These terms are an agreement between you and After Key Solutions Ltd (59-4660587) (“we”, “us”), which operates Afterkey at https://after-key.org. By creating an account, joining the waitlist or starting a claim, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the service.
2. What Afterkey is and isn't
Afterkey lets you write an encrypted note, for example where your crypto is and how to reach it, and give one or more heirs a printed card holding half of the key. The other half is released by us only after a waiting period that you can cancel, as described in section 5.
- It is not a will and doesn't replace one. It does not transfer ownership of anything. Who legally inherits your assets is decided by your will, trusts, beneficiary designations and the law where you live, not by Afterkey. Your note may conflict with those documents; we recommend talking to an estate planning lawyer.
- It is not legal, tax or financial advice. Nothing on the site or in our emails is.
- It is not a custodian or exchange. We never hold, move, manage or see your crypto or other assets, and we can't recover, freeze or transfer them.
- We don't check what your note says or whether its instructions are correct, current or lawful. We can't, because it is encrypted.
- We don't decide who is entitled to inherit. We release our half of the key to whoever holds a valid heir card when the rules you set are met.
3. Who can use it
You must be at least 18 and able to enter into a binding contract. You may only use Afterkey for yourself, not on someone else's behalf, unless you have legal authority to do so. You may not use it if you are barred from receiving services under applicable law, including sanctions laws.
4. Your account, passphrase and heir cards
- Your passphrase can't be recovered. Your note is encrypted with a key that only your passphrase unlocks. If you forget it and have no working heir card, nobody, including us, can open the note.
- Heir cards work like keys. Anyone who has a card can start a claim and, if it isn't cancelled, read your note at the end of the waiting period. Store cards safely, give them only to people you trust, and revoke a card in your dashboard if it is lost or you change your mind.
- Keep your email working. Claim alerts and check-in reminders are sent by email. You are responsible for keeping your account email and any extra alert addresses up to date and for checking them. If alerts don't reach you, a claim you would have cancelled may complete.
- Keep your account password secret and tell us promptly at [email protected] if you think someone else has accessed your account.
5. How release works
- Claims. A card holder can start a claim at any time. We email you straight away. A claim waits for the period you chose before anything is released, and you can cancel it with one click from the email or your dashboard.
- Sign of life. Any check-in from you cancels every pending claim.
- Documents. A claimant can upload a document such as a death certificate. If a person on our team approves it, the waiting period is shortened to 14 days from approval. It is never skipped. Reviewing a document is a reasonable check, not a guarantee that it is genuine, and approval is at our discretion.
- Dead man's switch. If you miss a scheduled check-in, we send you 3 reminders 7 days apart. If you don't respond to any of them, we start a claim for each active heir card and email the heirs who have an address on file. Those claims follow the normal waiting period, which you can still cancel.
- Release. When a waiting period ends without being cancelled, we release our half of the key to the card holder, who combines it with the half on the card to open the note in their browser.
These steps depend on email delivery, your settings and the service being available. We work to run them reliably but can't promise that every message will arrive or that release will happen at an exact time.
6. Your content and acceptable use
What you write in your note belongs to you. You give us permission to store, copy and transmit the encrypted note and related data only as needed to run the service.
You agree not to:
- use Afterkey for anything illegal, including to hide assets from creditors, courts or tax authorities in breach of the law, or to launder money;
- store instructions for accessing assets or accounts you have no right to;
- start a claim with a card you were not given, or upload false or forged documents;
- try to break, overload, probe or reverse-engineer the service's security, or access other people's data;
- resell the service or use automated tools to create accounts.
We may suspend or close an account that breaks these rules. Where it is safe and lawful, we will tell you why first.
7. Plans and payment
Afterkey is free during the beta. When paid plans launch, we will tell beta users by email in advance, and nobody will be charged without choosing a plan. The plans we plan to offer are 1 year for US$129 and 5 years for US$449, with a lower Founding Member price for the first 500 members. Current prices and any taxes are shown before you pay and are the ones that apply.
- Payments are processed by a third-party payment provider named at checkout, under its own terms.
- If a plan renews automatically, we will say so at checkout and remind you before renewal. You can turn renewal off at any time.
- Refund terms are shown at checkout before you pay. This doesn't affect any rights you have under consumer law.
- If a plan ends unpaid: after 7 days, your note becomes read-only, so you can no longer edit it or change settings. We email you a copy of its latest version, still encrypted with your passphrase. Heir cards you have already issued keep working, and pending claims, cancellation and the dead man's switch continue as before.
8. Beta, changes and shutting down
During the beta, features may change, and the service may occasionally be unavailable for maintenance or because of problems outside our control. We may change or remove features. We will not reduce the core protections described in section 5 for existing vaults without telling you in advance.
If we ever decide to shut Afterkey down, we will email account holders at least 90 days in advance where we reasonably can, so you have time to copy your note out and make other arrangements. Before paid plans launch, we will also publish a shutdown plan describing what happens to our halves of the keys.
9. Ending your account
You can close your account at any time by emailing us from your account address. Closing it deletes your encrypted note and our halves of the keys, so heir cards stop working permanently. Sections 2, 6 and 10 to 13 continue to apply after your account ends.
10. Disclaimers
The service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't warrant that the service will be uninterrupted or error-free, that emails will be delivered, that your heirs will be able to use the information in your note, or that any asset will be reachable, still exist or have any value.
11. Limitation of liability
To the fullest extent the law allows:
- we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, crypto or other digital assets, however caused;
- we are not liable for losses caused by a lost passphrase, a lost, stolen or misused heir card, an out-of-date or incorrect note, an email address that doesn't reach you, or a claim you didn't cancel in time;
- our total liability to you for all claims relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or US$100.
Some places don't allow these exclusions or limits, so some of them may not apply to you. Nothing in these terms limits liability that can't be limited by law, such as liability for fraud.
12. Indemnity
To the extent the law allows, you agree to cover our reasonable losses and costs arising from your breach of these terms or your misuse of the service, including claims by others about what you stored or the instructions you left.
13. Governing law
These terms are governed by the laws of Wyoming, United States, and disputes will be heard by the courts there, unless the law where you live gives you the right to use your local courts or laws.
Before going to court, please email us. Most problems can be solved quickly that way.
14. Changes to these terms
We may update these terms. We will change the date at the top and, for significant changes, email account holders at least 30 days before they take effect. If you keep using the service after that, the new terms apply. If you don't agree, you can close your account.
